TERMS AND CONDITIONS
Choosing, buying and arranging delivery/shipment
Purchases may be made instantly by clicking Buy Now on a painting's webpage and choosing the shopping cart payment method (debit/credit card or Paypal).
Most purchases benefit from free fully insured shipping by Special Delivery (UK) or Royal Mail International 'Tracked & Signed'. If this is not available in the country to be delivered then either ''Tracked' or 'Signed' is used according to availability and/or customer preference.
The condition of paintings are not included in website descriptions so customers are advised to request detailed condition reports before making a purchase. Please note: if no request for a condition report is made there can be no refund or exchange due only to matters regarding condition. (See important information below: 'Entering into a contract'.)
Buyers who do not make instant payments via the website shopping cart are invoiced with full costs including any postage/shipping/insurance. Arrangements for payment will be made prior to despatch. We accept bank transfers/wires, cheques in British Pounds (£) and cash paid person to an amount not exceeding £5000 PA; also payments via Paypal (buyers will be charged an additional 4% to cover actual costs). For UK buyers with internet banking a transfer is simple, quick and usually cost free. For EU and rest of world buyers most banks charge fees for transfers. It is the buyer's responsibility to pay all fees chargeable by their own banking system; Indian Miniature Paintings will only accept costs incurred by the British bank.
Each purchase is invoiced with full company details, inventory number(s) and brief description of good(s) purchased, amount paid and balance owed. Invoices to be emailed or sent with the shipment. This invoice is the buyer's guarantee of authenticity; separate certificates of authenticity are provided on request only.*
Please note that although full endeavours are made to convey colour accuracy in images online this cannot be guaranteed due to differences in PC processors, screens, etc.
Please also note any translation using Google translate is a guide only - its accuracy cannot be guaranteed and it is used at your own risk.
Contact with the company can be made by email at email@example.com or by phone 44 (0)7887390870. When requesting information for paintings please state each inventory number (starting LC00- for example LC000999).
The cost of each painting includes in-transit insurance against losses and/or damages. Once posted/shipped tracking information will be supplied. Cover is up to a maximum value of £20,000 per shipment.
Customer preference may be to ship via an independent courier (UK/International) of the purchaser's choice. This option must be arranged and paid in full by the purchaser. As an example FedEx shipments start from around £50 and may be up over £100 according to contents or size and chosen speed of service. The specialist international shipping companies Cadogan Tate Fine Art and St Albans Shipping (UK) provide overseas collection and delivery for works of art and antiques. Their costs start at around £200 for one single miniature painting to be delivered outside the UK. This option must be arranged and paid in full by the purchaser.
To date 100% of paintings sold (see the archive galleries for an indication of numbers) which have been posted or shipped using services above arrived safely at their destination. As yet no insurance claims for in transit loss or damage have been necessary.
Entering into a contract
For online purchases clicking the Buy Now button enters the buyer into a binding contract; for purchases made by Paypal, bank/wire transfers, cheques, or cash, a binding contract is entered on issue of payment. The law applicable to any transaction will be that of England and Wales and without regard to the location of the purchaser.
*Purchasers are entitled a refund of purchase price where an item is proved to be significantly different from the invoice/receipt description (or condition report if requested). Such proof regarding goods not being as described must be provided in writing from a person accepted by both parties to have the required knowledge and expertise in the field of antique Indian miniature painting. It is the responsibility of the buyer to determine condition of goods prior to purchase and the seller strongly recommends requesting a condition report before deciding to complete a purchase. For buyers requiring purchases to be sipped to another country it is the sole responsibility of buyers to pay all import taxes and fees. Returned paintings will not be accepted without prior agreement. The buyer is responsible for cost of return of goods including import VAT as determined by UK HMRC. In such instances provided goods are clearly labelled 'Return of goods' no import fee is payable.
